On August 6th of 2009, Sonya Sotomayor was confirmed as a Supreme Court Justice. Republicans were disappointed, but the ideological balance of the court was not in jeopardy. And, understanding that elections have consequences, nine Republican Senators voted with all the Democrats to confirm her, and a Senate filibuster was never seriously considered. Almost exactly one year later, Elena Kagan was confirmed as a Supreme Court Justice. Republicans were no less disappointed than the previous year, but again, the ideological balance of the Court was not going to change. Thus, still understanding that elections have consequences, five Republicans joined with all of the Democrats (except Ben Nelson), to make her the most recently appointed Supreme Court Justice. Again, though the final vote in the Senate was a little closer, a filibuster was never seriously considered.
